Welcome to Everwhen. These Terms of Service ("Terms") govern your use of the Everwhen application and services ("Service"). By accessing or using our Service, you agree to be bound by these Terms.

By creating an account, accessing, or using Everwhen, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
You must be at least 13 years of age to use this Service. If you are under 18, you must have permission from a parent or guardian. By using the Service, you represent and warrant that you meet these age requirements.
Your use of the Service constitutes your acceptance of these Terms and our Privacy Policy. These documents together form the complete agreement between you and Everwhen.
To use certain features of the Service, you must create an account. When creating an account, you agree to:
You are responsible for maintaining the confidentiality of your account credentials. We use industry-standard security measures (bcrypt password hashing, JWT authentication) to protect your account, but you must also take reasonable steps to protect your login information.
You may delete your account at any time through your account settings. Upon account deletion, all your data (tasks, events, preferences) will be immediately and permanently deleted as described in our Privacy Policy.

We strive to provide reliable service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to minimize downtime and notify users of scheduled maintenance.
Everwhen uses artificial intelligence to enhance your productivity experience. By using our AI features, you acknowledge and agree to the following:
Our AI generates task recommendations based on your goals, schedule, and preferences. These are suggestions only — you decide what to accept, modify, or decline. AI suggestions do not account for all personal circumstances and should be evaluated using your own judgment.
The voice assistant provides real-time AI-powered schedule management through natural conversation. The voice assistant may make errors, misinterpret instructions, or provide imperfect suggestions. You should verify any schedule changes made through the voice assistant.
AI-assisted event and task scheduling is based on your preferences, location, and availability. Smart scheduling optimizations are algorithmic recommendations and may not account for all relevant factors in your life.
AI-generated content, including task suggestions, scheduling recommendations, and voice assistant responses, is provided "as is" without warranties of accuracy, completeness, reliability, or fitness for any particular purpose.
You should review all AI suggestions and recommendations before acting on them. You are solely responsible for any decisions made based on AI-generated content. We are not responsible for any consequences arising from decisions made in reliance on AI suggestions.
AI features may be modified, improved, or discontinued at any time without prior notice. We make no guarantees regarding the continued availability or performance of any specific AI feature.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service:

While we implement backup systems for disaster recovery, you are responsible for maintaining your own backups of critical data. We recommend regularly exporting your task and calendar data through the available export features.
You retain all ownership rights to the data you create, upload, or store in the Service (tasks, events, notes, etc.). By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of providing and improving the Service.
The Service and its original content, features, functionality, and design are owned by Everwhen and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
The application is licensed, not sold. Your use of Everwhen is governed by these Terms, and no ownership rights in the application are transferred to you. You may not copy, modify, distribute, sell, or create derivative works of the application or any part thereof, except as expressly permitted by these Terms.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or obligation to you.
The Service integrates with third-party calendar providers (Google, Apple, Microsoft). These integrations are subject to the availability and terms of service of those third-party providers. We are not responsible for:
Location features rely on Mapbox Geocoding API. Accuracy of location data and geocoding results is not guaranteed. Use of Mapbox is subject to Mapbox's Terms of Service.
If you grant HealthKit permissions, Everwhen accesses your health and fitness data on a read-only basis to provide personalized productivity insights. HealthKit data is:
You can revoke HealthKit access at any time via iOS Settings > Privacy & Security > Health > Everwhen. Revoking access will disable health-related productivity insights but will not affect core scheduling functionality.
The AI voice assistant uses LiveKit for real-time audio streaming. Audio is processed in real-time during active voice sessions and is not recorded or stored after the session ends. Use of this feature is subject to LiveKit's Privacy Policy.
Our integration with third-party services does not constitute an endorsement of those services. We are not responsible for the content, privacy policies, or practices of any third-party services.
Everwhen may offer subscription-based access to premium features. Details of available plans, pricing, and included features are displayed within the application and on the App Store listing.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time through your device's App Store settings.
All payments are processed through Apple's App Store. Everwhen does not directly collect or store any payment card information. Payment processing is subject to Apple's terms and conditions.
Refund requests are handled through Apple in accordance with their refund policy. To request a refund, contact Apple Support or visit reportaproblem.apple.com.
We reserve the right to modify subscription pricing. You will be notified of any price changes in advance, and continued subscription after the price change constitutes acceptance of the new pricing.

While our scheduling engine uses advanced algorithms to build your schedule, we do not guarantee:

ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE MAKING HEALTH-RELATED DECISIONS.
AI SUGGESTIONS, INCLUDING TASK RECOMMENDATIONS, SCHEDULING OPTIMIZATIONS, AND VOICE ASSISTANT RESPONSES, ARE NOT PROFESSIONAL ADVICE AND SHOULD NOT BE RELIED UPON AS SUCH. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Everwhen, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

WE ARE NOT LIABLE FOR FAILURES OF THIRD-PARTY SERVICES, INCLUDING BUT NOT LIMITED TO GOOGLE, APPLE, LIVEKIT, OR MAPBOX, THAT MAY AFFECT THE AVAILABILITY OR FUNCTIONALITY OF INTEGRATED FEATURES.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Everwhen and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

We recommend exporting your data before deleting your account, as deletion is irreversible.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
You agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the courts of Turkey. The courts and execution offices of Istanbul (Çağlayan) shall have exclusive jurisdiction over any disputes arising from these Terms.

The parties may mutually agree to submit disputes to arbitration in accordance with the Istanbul Arbitration Centre (ISTAC) rules or the International Chamber of Commerce (ICC) arbitration rules, with the seat of arbitration in Istanbul, Turkey.
We reserve the right to modify these Terms at any time. We will notify you of material changes by:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Everwhen regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Everwhen.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, pandemics, internet failures, or government actions.
